New York's Labor Law §240(1), known as the "Scaffold Law," imposes absolute liability on property owners and general contractors for gravity-related injuries on construction sites — including falls from scaffolds, ladders, or roofs, and injuries caused by falling objects. This is one of the most powerful tools for injured construction workers in the country, and Jonathan specializes in these cases.
New York follows a "pure comparative negligence" rule, meaning you can recover damages even if you were partially at fault — your recovery is simply reduced by your percentage of fault. For example, if you were 20% at fault and your damages are $1,000,000, you can still recover $800,000. Don't assume you can't recover because you contributed to the accident.
